I need advice on how to recover a mistaken excess payment from a merchant who verbally promised to refund and is now refusing.
Here is exactly what happened:
1. I engaged Rupsha Infotech, Keshtopur, Kolkata for a laptop repair found through JustDial.
2. I paid ₹5,000 as advance on 29th April 2026.
3. The final bill was ₹16,000. Since ₹5,000 was already paid the remaining due was only ₹11,000.
4. By mistake I paid ₹16,000 instead of ₹11,000 on 30th April 2026 resulting in an excess payment of ₹5,000.
5. The owner verbally acknowledged the mistake over phone and promised to refund ₹5,000.
6. After repeated follow ups he only returned ₹2,000 and has now explicitly refused to return the remaining ₹3,000.
7. He is no longer picking up calls or responding to messages.
Proof I have:
✅ UPI payment receipt for ₹5,000 (CRED, 29th April 2026)
✅ UPI payment receipt for ₹16,000 (Transaction ID 612082511530, Google Pay, 30th April 2026)
✅ UPI receipt showing he refunded ₹2,000
✅ Call records showing repeated attempts to contact him
