May 1, 2026 at 4:53 pmMy grandmother( illiterate) has 11 children. Most family properties were already divided earlier. She still owns about 24 cents of land which includes an old house in her name.One of my uncles has been living in that house for years along with my grandmother and the general understanding in the family was that the house would go to him.
However, since there were some murmurs from other siblings about the grandmas property, I got a registered will made based on my grandmother’s wishes. In the will, she has clearly stated that:
50% of the property goes to that uncle (who is staying there) and 50% goes to my father.This will is currently not known to the other siblings.
Now, the uncle is concerned that wills can be challenged in court and wants the property to be registered (transferred) now itself to avoid future issues. But I am worried that doing a transfer now might trigger disputes among the other siblings and affect my grandmother emotionally.Can the will be challenged in court and cause issues in future after my grandmother’s death? I want to keep this ancestral house to be with this uncle who is decent and not cause any conflict or further breaking of asset equally with everyone which will break the ancestral house.
What is the safest approach legally in India to minimize future disputes while also avoiding family conflict at present? Is the will good enough or better to transfer the property now.
