From what I understand, POSH complaints (under the Prevention of Sexual Harassment Act) are taken very seriously by companies, and even an allegation can have immediate consequences. But I want to understand the *worst-case scenario* in more depth—legally and practically.
Let’s say a situation where:
* A false POSH complaint is filed
* The Internal Committee either believes it or the company decides to err on the side of caution
* The guy gets terminatedMy questions:
1. **Career impact:** If someone is terminated due to a POSH complaint (even if false), how badly does this affect future job prospects?
2. **Background verification (BGV):** When joining a new company, do employers in India typically conduct deep background checks that would uncover such a case?
* Do previous employers disclose *reason for termination*?
* Or do they usually just confirm dates/designation?
3. **Legal recourse:** If the complaint is proven false later, what remedies does the accused have? Is it realistic to pursue defamation or action against malicious complaints?
4. **Worst-case scenario:** What is the absolute worst that can happen to someone’s career and reputation in such a case? Are we talking about temporary setback, or something that can permanently derail someone professionally?I’m not trying to undermine genuine cases at all—I understand POSH exists for an important reason. I’m just trying to understand the risks from the other side if the system is misused.
