April 30, 2026 at 9:34 pmLocation south IndiaMy grandfather built a house with a common wall and left separate portions (with separate deeds) to me and my cousin brother. My family lives in my portion, while my cousin’s portion is currently occupied by tenants.
The Situation:
My cousin wants to sell his portion.
They ask me to buy that portion, I was thinking about price negotiation. Meanwhile they approach with tenant.
The current tenants have paid him an “advance” and signed an unregistered agreement to buy the house without my knowledge or consent.
I have already sent a legal notice to my cousin family.
The Problem: The tenants are now trying to take advantage of the situation. There is currently a break/crack in the common wall, and I am worried they will try to make structural changes or encroach on my side.
Legal Questions:
Since we have separate deeds but share a common “party wall,” can I get a stay order (Temporary Injunction) to stop them from touching or altering the wall?
What is the best way to stop the tenants from taking advantage of their possession of the property while the legal dispute is ongoing?
I am planning to file for a Status Quo order to freeze any changes to the property. Looking for advice on how to handle the common wall damage and protect my property rights.
