April 30, 2026 at 11:18 amHi all,I purchased a flat in an apartment on 30th August 2018, and the sale deed was registered, but **years later, the flat is still not in my name**, and there’s an issue where the land “belongs to the government.” Apparently the builder has constructed 23 flats and sold them all.
Here’s a quick timeline:
* **April 2019**: Applied for RTC (Pahani) at the City Survey office, was told to contact the builder.
* **May 2019 – August 2021:** I contacted the builder multiple times. The builder assured me that the issue would be resolved and that the RTC would be provided.
* **Aug 2021**: Builder said RTC was ready, but City Survey office again claimed the land belongs to the government.
* **Sept 2021** : I discovered that the land belongs to the Karnataka Government, and therefore, they could not issue the RTC –> (the records from **24th March 1987** show that plot belongs to KA Government**.** On **18th DEC 2000** ,ADLR transferred the record to the Owner without mentioning the Deputy Commissioners record reference number)
* **February 2025:** A new ADLR official joined the Survey office. I met with them to explain the issue.
* **February 2025 – March 2025:** I submitted a new application to the ADLR office on **11th February 2025**. The response I received on **14th March 2025** stated that there is no record from the Deputy Commissioner’s office showing the removal of the government name from the property records in **December 2000**.
* **Current Situation:** The ADLR office is now asking me to provide a copy of the Deputy Commissioner’s order, which I attempted to retrieve from the DC Office in Dharwad. However, the document is **not available** in their records room.The builder has not taken responsibility, and the government offices (both the City Survey office and DC office) are not providing the necessary documents.
**Questions:**
1. How can I legally resolve this and get the RTC?
2. How do I obtain the Deputy Commissioner’s order or work around this?
3. Can the builder be held accountable for ignoring this for years?Any advice or experiences would be super helpful. Thanks!
