UHi everyone,
I’m facing a situation with my employer and wanted some legal guidance.
I was recently given an official increment letter increasing my salary. The revised salary was also updated in the payroll system and reflected there initially.
However, after I resigned, my salary was reverted back to the old amount without any prior communication. My latest salary credit and payroll now show the old salary.
Important points:
I have a written increment letter confirming the revised salary
There is no clause in the letter about increment not लागू during notice period
The updated salary was already reflected once in the system before being reverted
No one informed me about this reversal
I’ve reached out to HR but haven’t received a clear response yet.
My concerns:
1. Is this legally allowed?
2. Can a company revoke an increment like this without prior notice?
3. If they refuse to correct it, what are my options (labour complaint / legal notice / court)?
4. Will this impact my future salary negotiations if my last payslip shows lower salary?
Would really appreciate any guidance on how to proceed. Thanks in advance!
UPDATE:
Had a call with HR. They said it’s a “general policy” that increments don’t apply if you resign during the increment cycle. However, this was never mentioned in my increment letter. When I pointed out that I already received the confirmed increment letter and that the increment was based on my last year’s performance, they were unable to give a clear explanation and gave a very vague response.
