April 28, 2026 at 5:12 pmIโm getting into a business partnership wherein I get technology to manufacture a product + the brand name. The brand name is famous in its domain and known for its quality.The person Iโm entering in partnership holds the Wordmark registration awarded to him in 2024.
I got to know that some other company also uses the same brand name, they are bigger in size both revenue and other scale metrics. They used Brand name TM and not Brand name R <possibly applied and not awarded> in 2017 as per a compliance document on their website.
My partner applied in 2022, got opposed and they the other party didnโt reply after opposing so he was awarded the registration in 2024.
My partner isnโt using the name at that scale the way the opposing party is.
Someone else is using it, and now if I start a business around it. Are we wrong given we have registration?
Considering I take up the name, build a business around it and the opposing party sense that we are in conflicting situationโฆ.what can they do to me?
Who is wrong in this situation and what are my risks? What should I do today to prevent them?
