UHello Fellow redditors,
Need some help regarding my parking dispute with the society as i am in quite a predicament. Any help would be greatly appreciated.
So I have been residing in Nerul for 6 yrs now, and have only recently discovered that the apartment (flat 402) i had purchased in 2020 had a parking slot covered. As the previous owner of my apartment, (Lets call him Mr. Fraud) tried to sell this parking slot to my neighbour (Mr B), claiming that he (Mr. Fraud) is the legal owner of this parking slot. Clearly an illegal step since he relinquished all claim to this property and its benefits in 2020 in the agreement with me.
Chronology:
But before he sold this flat (402) to me, he had made a power of attorney (year 2015) to let his brother (Mr. Fraud B) in flat 401, use the parking.Mr. Fraud A sold 402 to me in 2020 and the paperwork has no mention of any covered parking in my sale deed. Intentionally hidden = Illegal?
In 2023, he sends a letter to the society to approve the transfer of parking from 402 to 401, as his brother (Mr. Fraud B) wanted to sell 401 to a new buyer (Mr.New). The society apparently rejected this letter saying, he is not the current owner and that he should approach me for Approval forst. Which Mr. Fraud never did. The society member also shared a photo of the builder’s allotment letter to Mr. Fraud dated 2008, mentioning that 402 unit has a covered parking.
Now, the new owner (mr. New) of 401, is claiming to have covered parking too, claiming his Sale Deed mentions a covered parking. I have asked him to share a copy to clarify everything. SO basically mr. Fraud B sold mr. New the parking basis the power of attorney he had done in 2015.
I am at my wits end here…
What’s the best course of action in this case?
