Are those paying their lawyers fee “per hearing” taking a huge risk?

My case in Kar HC was listed for a “Special Bench” hearing yesterday. The Bench meets every two weeks and my case had already been adjourned a couple of times after initial hearing.

I logged in to VC at 2.30 and after waiting 15-20 minutes, and heard the court officer announce that the “Special Bench” had cancelled hearing for “unknown reasons.”

Just like that.

Of course, we are not supposed to “question” the whims of judiciary so I will refrain from that.

However, it made me wonder about litigants who have an agreement to pay their lawyers “per hearing” fee. In a situation like this, they still end up paying since the matter was listed and lawyer present. Yet another cost of litigation in India?
