        Hi everyone. I am dealing with a massive land grab and a highly corrupt revenue department nexus in ratnagiri, Maharashtra. I need solid legal strategies to force administrative action because I refuse to fall into the 15-year trap of filing an eviction suit in a Civil Court.Since I stay in Mumbai 300km from the land and if I file case I have fear that my lawyer might get compromise and just keep tarik pe tarik by other party to drain me physically and financially.

        Here are the facts of the case:

        โ€‹1. The Encroachment: I own a plot of land (the 7/12 extract is entirely in my family’s name). An encroacher has built a 2-story unauthorized building(mistakenly wrote 5 story on title) on it without any permissions which is still under construction.

        2. The Initial Demolition Notice: After my complaints, the local Tehsildar officially issued a Demolition Notice in October 2025 under Sections 52, 53, 56, and 57 of the MRTP Act.

        3. The “Civil Matter” Trap: Literally a day later, the Tehsildar closed my complaint file. In his official letter, he stated that the encroacher produced a Power of Attorney (PoA) allegedly given by my late father in 2010. The Tehsildar wrote: “Since he has submitted a PoA, this is a property dispute. Go to Civil Court.”

        4. The RTI: I knew the PoA was fake, so I didn’t go to Civil Court. Instead, I filed an RTI asking for the register entry of that specific 2010 PoA number. On April 3, 2026, the Tehsildar’s own office gave me a written RTI reply stating: “No such PoA exists in our registers.” The document is 100% forged and was used to cheat the government.

        5. The Current Standoff: afterthat I confronted the Tehsildar with this RTI. Since his own office proved the document is fake, his “Civil Matter” defense completely collapsed. He couldn’t ask me to go to civil court anymore. Instead, he started sweating and is now stalling with the classic bureaucratic answer: “I will look into it.”

        Problem is I tried every office with complaint but every complaint goes to tehsildar office again and again and he does nothing.

        My Questions for Legal Experts here:

        โ€‹Writ of Mandamus: Since the Tehsildar is sitting on a 6-month-old MRTP demolition notice and refusing to act despite undeniable proof of forgery, how fast/effective is filing a Writ of Mandamus in the Bombay High Court to compel him to demolish the structure?

        โ€‹CrPC 156(3) & Criminal Conspiracy: The Tehsildar is legally bound to file an FIR since fake documents were submitted to his public office. Since he is stalling to protect the encroacher, should I file a private complaint under Section 156(3) CrPC before the Magistrate, making the Tehsildar a co-accused (IPC 120-B)?

        โ€‹Administrative Traps (ACB / Lokayukta): The Tehsildar’s sudden reluctance to act screams bribery. Has anyone had practical success filing complaints with the Maharashtra Lokayukta, the Anti-Corruption Bureau (ACB), or using the Maharashtra Delay in Discharge of Official Duties Act, 2005 to get a corrupt official suspended?

        Any advice on how to tighten the noose around this corrupt official without spending years in a civil trial would be highly appreciated!

        I have proofs of their fake Panchnama in which they hide 3 shops and 2 floors of building just to keep fine lower,

        After I asked them about details circle officer blocked me. Mrtp act notice was never sent to me just to hide the fact and make me go to court now since I know notice was given with 1 month deadline I’m telling them to demolish it since I am not asking them to give me possession. And their voice recording of asking me to talk to encroacher and sort it out.
