Product: Samsung Monitor (โน7,299) purchased Dec 2024.
Issue: Persistent dots and backlight bleed within 3 months.
Timeline: 14 months of back-and-forth, 6+ technician visits, and multiple “damaged” replacement panels sent by Samsung.
The Turning Point (Physical Damage):
On April 22, 2026, an authorized technician came for a panel replacement. During the process, he was aggressive with the unit and physically scratched the plastic frame and caused an intermittent short on the motherboardโs DisplayPort. I have video/photo evidence of the damage he caused to my property.
Current Status:
After escalating to the CEO Desk and filing an NCH grievance, Samsung is now offering an 83% “Commercial Settlement” (โน6,058) via a physical cheque, citing depreciation. They will pick up the unit when they hand over the cheque.
The Complications:
Missing Items: I no longer have the original box, the stand screws, or the HDMI cable (lost/discarded after 1.5 years).
Property Damage: I argued that depreciation shouldn’t apply since they physically damaged my property, but they aren’t budging past 83%.
My Questions:
Can Samsung legally deny or deduct from the promised โน6,058 refund because I don’t have the cardboard box or a โน200 HDMI cable?
Does the property damage caused by their staff legally waive the “standard depreciation” under Indian Consumer Law?
If I accept the 83% cheque, do I lose my right to file in E-Daakhil for the remaining 17% and mental agony later?
Any advice from lawyers or people who have dealt with Samsung “Commercial Settlements” would be greatly appreciated.
