April 24, 2025 at 2:35 amWe purchased a flat from Mrs Y mid last year. The flat was in a family dispute, we purchased it only after a High Court probate and a registered Transfer Deed executed in Mrs Yโs favour by her brother, Mr. X. X and Y fell out when Y started negotiating with us. X has the original papers of the property except for the Deed of Transfer. Y registered an FIR and also took out newspaper ads for the original documents.Society transferred the share certificate to Y only after Y approached the Registrar for help.
X then sent letter to registrar saying the flat was illegally transferred. Registrar sent auditor to check, who after checking the papers verbally said all was ok. No written report was given though.
After this we purchased the flat from Y, through a bank loan and registered Agreement of Sale and Sale Deed.Now the society is not transferring the shares to our name asking us to go to registrar and get an order in writing. I have been paying maintenance regularly since last year. Even though the utilities are now in our name the Society maintenance bill is not.
What can we do? Can I stop paying the maintenance until the society transfers the certificate? Please help.
