I have a personal loan in Kuwait, due to Covid 19 I lost job and came back to India, till the time I was in Kuwait I paid all the emi’s on time. Due to difference in income levels with the salary that I have in india I cannot payback the loan of kuwait, bank has appointed some third party bilkish who is threating of legal and criminal proceedings against me in india. It would be helpful if you can guide me the options that I have.

They are quoting some rejecting bail petitions in kerala as reference.

Donโ€™t bother to respond or pay. If the amount is not large, ignore and tell the caller you are filing a harassment case.

Can you explain further if possible? What are the options in best case and worst case scenarios?

The loan is not in India. At best they can file a civil case in Kuwait to get you to pay. They are just trying to scare you to pay a loan they know itโ€™s not legally tenable in India. If they could have filed a civil or criminal complaint in India, they would have already done that. They canโ€™t. So they are trying to scare you.

A lawyer told me to go for one time settlement based on the fact that civil case judgement in Kuwait can be used and file a civil case in india, in these types of cases courts usually side with banks and ask the customer to payback with outstanding with interest. What’s your take on this!? Are you a lawyer by profession. Sorry if I overstepped. Just wanted to take confirmation

I had an outstanding CC debt in Singapore in 2007.
Didnโ€™t pay it as my employer had removed me without notice or lending pay.
                          Returned to India.
Citi asked me to repay the outstanding debt. Told them to go fuck themselves.
They tried collecting in India through their branch.
Complained to RBI ombudsman about illegal and fake CC charges when I didnโ€™t hold a CC in India.
                          Citi quietly stopped contacting me.

Hello. I am a practicing advocate. Do not pay. Let them take whatever legal action they can. It is anyway a civil matter, unless they resort to cheapskate methods of filing a false FIR. Please do not hesitate to reach out and send a personal messgae if you need any further assistance in the matter.

                        NAL:

If you don’t want to pay then don’t.

However make sure that you never travel / transit through GCC countries in the future as depending on the amount (if greater than KD 1000 usually but lower too depending on the bank, some go as low as even KD 100) there will be a lookout notice for you.

They can do nothing to you in India. You can ignore them
