My father has signed a bayana agreement for the sale of his home to his neighbours. (They share the same wall to our house)
What he did not notice was that the bayana agreement stated that the full payment would be made over 5 years, however the buyer will take the possesion immediately.
The agreement also states that the they have paid us 10 lakhs in account and 30 lakhs in cash with this agreement and the total property value has been agreed upon as 1.5 Cr.
In case we refuse to honor this agreement we need to pay back twice of 40 lakhs that they have paid to us ie. 80 lakhs to get out of this agreement.
The agreement has not been notarized.
What are our options to get out of this.
