EMarried to mentally unstable girl.
Barely 2 months within the marriage and she only stayed for 10 days.
She has clearly some mental issues which we started noticing within few days of marriage. There is no doubt that ahe has mental issues.
She has already filed fraudulent complaints of dowry cases against me at the police station.
I want to get out of this marriage .
Can i file for an annulment? -
GYes, if you were not told about her illness before the marriage then yes you can file for annulment of marriage as you were deceived by her and her parents. Though make sure you have sudden proof of her illness like any medical records or video of her outbursts. Engage an advocate now.

GNo, annulment of marriage and divorce are two different things. Mutual divorce is ideal but both parties need to be on the same page and would take 6 months cooling off period. In this case it is ideal to file for annulment of marriage, it will be treated as marriage never happened, also mutual divorce won’t work here as woman have already filed so many dowry cases against him. She must want to mentally torture him and get handsome amount in the form of maintenance from court.

IYeah that’s something i wonder too. Because, if we are talking about having sex. The courts are pretty regressive on this.
Like when it’s about being the biological father of the child or not. The court accepts no dna test. The only thing they’ll accept is that during the time period child was conceived, the husband has to be geographically away from the wife. If they lived together or there was a possibility that they could had met then the court will go with the opinion they had sex and the child is his.

EDon’t know the legal term but she is mentally unstable and most probably she is taking medicine for that which is hidden from me.
She goes to her house every day or other and comes back. It’s crazy i know but that is what it is. -

CBait post. Simple scroll on OP’s account shows him talking about moving abroad with wife and 2year old baby barely 6months ago. It’s super unlikely he got divorced, newly married for 2months already, n so careless with choosing a new partner with child, all in such short time-frame. Doesn’t make sense at all.

LProving mental unstability is very difficult. The entire procedure can take upto 35 years if the OP keeps challenging it from Family to High to Supreme Court.
Eg: Vinita Saxena vs Pankaj Pandit on 21 March, 2006 where marriage was done in 1993 and Husband was a Paranoid Schizophrenic. Divorce filed in 1994 and matter kept getting challenged until SC gave final order in 2006.
All of this in case of a Woman where court is already in favour of. You are a Man and Judiciary already is against you. It will balance the dangers you dace remaining married to a Mentally unstable woman vs the social ramifications of a Woman getting Divorced. And unless there is a direct threat to your life and limb, you won’t get divorced/marriage annuled.
Moreover as per recent ruling of Supreme Court Husband can be asked to pay Alimony under HMA 25 even in Void Marriages. So be ready to shell out lakhs or crores to ameliorate the pain of a Woman getting her marriage annulled due to you.
Better to join some Men’s Rights NGO and start learning the Law rather than filing Annulment.
Filing any such case without proper knowledge will be a disaster especially in light of the fact that you already are facing other cases from her.
Don’t forget she can also file another Maintenance Case of HMA 24 when you file Annulment. So don’t give fuel to the fire.
