UShe claimed that the eviction notice was in the name of Rajendra Yadav, but she’d been the one to pay the rent from her bank account. Initially, she posed as this man’s wife, then said he was her cousin, and now, she says she doesn’t know him. They lived together in that house for 3 years and have two children!
Apparently, the judge thinks it’s possible that her husband Raju Yadav has nothing to do with Rajendra Yadav, and the FIRs filed against her son which mention my property’s address are proof enough to nullify the eviction. She’s back in that house. Because her cousin husband signed the lease and has now vanished. Her son is a violent, gun-toting criminal. My parents are elderly.
It’s been years. Maybe if I killed myself, the news would pick it up and we’d have our house back.
If you get an eviction for a tenant outstaying their lease, can their family members just show up and claim they haven’t been specifically evicted, and let the case fester for another couple years?

UHey man, You can always go for an appeal and with the right/wrong advocate you are on your way to get back what belongs to you.
To tell you the truth, you’ll be in endless years of litigation over this. If you ‘win’ the case, they’ll probably prefer an appeal.However, It’s no reason to ‘off’ yourself over this. I understand that it might be your sole property and one that your family’s life depends on. But imagine, even if you are gone, anyone depending on you will be shambles. Who’ll fight for your property after you’re gone.
Remove the thoughts from your head and think positively about getting your property back.
It’s sad that our country has become a land for no sane man. Please also consider the recent case of Atul Subash, man made a video and a letter before he ‘off’d’ himself. Nothing came out of it. In a few years/months he’ll be forgotten and the abusers roaming free.

UI was thinking about Atul’s case when I got this recent judgement. This home was supposed to be for the entire joint family to live in, after years of staying elsewhere to focus on career and education. I’m in the last phase of my youth, but my elderly father and I are running from pillar to post despite having every paper.
The scariest part is being embroiled in this with those criminals. They’ve threatened us, and they’re very obviously insane, uncaring of my long-term consequences. I’ve become paranoid about them causing us harm.
I have a date for next month. Another humiliating day at court, and perhaps years of the same thing, is all I have to look forward to in life.

UTrue, sometimes we might feel that life in general is very unfair to us. We see people enjoying their life, their homes, stress free and think why we can’t have that even though we didn’t do anything wrong.
It’s also sad that people having absolutely a criminal mindset are enjoying things. People skew justice towards their side with power and money, it’s not new but it’s nothing we common people can do to stop.
Let’s work on things we can change. Nothing to lose hope in life as is. Hopefully, you and your family get the turnaround you need and live happily. Take care of your elderly parents.

Nobody in the entire world cares more about my father or brother than I do. The men in my life are just as precious to me as the women. This is the case for most people.
If legal harassment is enough incentive for you to judge women, then what sort of judgement do men deserve for getting away scot free with domestic violence, rape, etc.? A 50 something year old man in the UK recently bit off a 19 yr old girl’s lips because she ignored him on the bus and only got 6.5 yrs time for it. The law is skewed in the favour of criminals. Understand that.
I care about Atul now? What? Don’t I have men in my family and friends? Being a feminist means I want women to be able to make their decisions and be safe, have the freedom to live their life with dignity and opportunities that men have… Do you want something different? Where do you get off judging me without any reason in Atul’s name? Should I be referring to Nirbhaya every time I speak to a man?
Fix your relationship with the women in your life, and if the issue isn’t that, then perhaps focus on contingencies for your own future relationships with women. I’m single and my entire life is dedicated to my family. I’m not the right person to dedicate this hostility towards.

India is a shithole but now and then a ray of hope glimmers. Try to keep up the fight. Your elderly parents have not lost anything till you are there for them. They will lose everything if they lose you. You and your parents’ existence is over and above all material things. I know easier said than done but you also know it’s true.
Sorry that we are Indians, but now that we are, let’s do our best. Fight man, fight.

UCalculate all the money you have spent in the legal process or would spend in future and donate that to a local politician or babu and let him handle that or sell the house to a builder at a lower price than the circle rate . This way you can save yourself and your parents from mental agony . Even if all this does not work you will be saved from the rigid and time consuming process of the judiciary.

UFile appeal before the appellate authority or HC as the case may be. Depending on your local law, the tenant will be directed to deposit regular rent in Court.

PAnd then what? People will forget about it eventually and the people who would be jailed will get bail sooner or later. You think your precious life is worth getting back at them, that too, partially? No. Suicide isn’t the answer to literally anything. The only person losing something would be you.
Figure out a strategic way to sue them all and file criminal complaints after consulting a good lawyer. -
UYes this is a common tactic by people who try to take control of other’s properties they had been renting.
So sad that you had to face an incompetent judge. Just go to a higher court, the moment your case finds the right judge your problems will be solved and your pending money will also be given back to you. Find a better lawyer too if you think your current one is incompetent

I have played a few of these landlord- tenant games.
Nothing to worry about. It’s just a game of patience and a few tricks.
Your problem is not the tenant. There are several tenants like these who play such mischief. Your problem is the judge and mainly your advocate.
Find a new advocate for the appeal, preferably withing your network who has experience with such cases. They would know about how to nullify all tricks of tenants. Read up online on how these games are played. Educate yourself on tenancy related laws and guide your lawyer if needed.
Don’t take stress with this. You will gain possession very soon. Your family is still the owner.
Give this less than 1% of your time and energy and focus on your life.

CIf you are planning to off your self conceder getting a gun and clearing the home before you off your self it will help your parents more than just killing yourself or just keep fighting in court.

CWell I am just one really bad day away from knowing what’s really bad with me. I also advise not to do what I say but it’s better than plain old Sucide where only your loved ones suffer. So, According to me if you decide to take your own life you lose all your morals and hence doing immoral things shouldn’t be any big deal for you like Luigi Mangione.

BI feel so sorry for you OP. But can anyone make me understand the logic for the judgement, even if the judge was bribed won’t it be caught easily as this judgement looks suspicion
Not giving the house back to owner, even if the woman paid the rent ,why does it matter she and her family stayed there,why is it important to judge that rent be paid from Rajendra account?.seriously indian law is twisted.

UA judge himself said to me that no matter how cut and dry a case is, it needs to be stretched for a minimum of 2 years, or tongues will wag.
This was off the record during an interview.
They don’t care about common sense.
My guess is they are trying to frustrate us to the point of agreeing to sell to them (they kept saying they wanted to buy the house some years ago), post which they would have us running after them for the rest of our natural lives for the money.

What’s stopping you from breaking the lock, throwing their stuff out, (through hired goons or lots of male members, and then proving in court that some other tenant has been living their (one of your family friend can show backdated rent recipts) and previous ones left by their own will.-
USince the matter is in court, and the judge gave her relief, doing that would land us in hot water. Initially, when we asked her to leave after the lease had ended, she took off her clothes and threatened to file an FIR.
She also tried to change the lease contract to show 9 instead of 3 with a pen. She’s an idiot, but apparently, that works in her favour in court.

BBrother, 100,000’s of people die in our country every year of suicide and really no one cares. Don’t think you killing will solve anything. Just your loved ones will miss you, and your property will still be occupied by her.
Is there not a higher court you could go to? If WorseWorst comes to worst, I say get local going and bribe the local police to help you kick them out, and occupy the property right after.
Once out, what’s stoping you from claiming they left on their own and now you live there.
