February 10, 2025 at 12:27 pmMy sister (26F) got hit by a bike last week on a road accident. He was trying to escape the lisence and helmet checking and took a u turn hitting my sister. The police took the picture of his number plate and took my sister to the hospital.She broke her right leg, got plaster, admitted into the hospital, went through surgery and plates were inserted. Anddd 3 stiches.
The police found out that guy. His bike was registered on his mother’s name. (He lives in a basti) At first he denied and said I didn’t hit her she did. But ofc police were present there during the accident. So he couldn’t lie.
Now, his parents comes to hospital begging my sister and our family to not file a case against them as they are poor and can’t even afford to compensate.
She said “we bought a bike for him 3 months ago in installment he’s 20 yo doing diploma. His life will be ruined” and etc…
Right now we’re not the condition to file a case but my brother (21M) is telling our parents to do so.
So if we file a case, what will be the actions taken against him??
Edit: forgot to add that her mother said she’s a maid. (And that guy didn’t even come to apologise)

Sometimes examples need to be made, else “chalta hai ” atitude will destroy next person’s life.If that guy can afford a bike, surely he can afford a license and helmet. He didn’t , shows his priorities. File FIR with medical reports.

Around a year back, a bike guy made a illegal cross and hit my scooty. I was thrown off and had abrasions in my elbow and knees. Since it was superficial I didn’t think much of it. The next day I took a x ray and found a hairline fracture in my toe. The recovery was very painful and the guy got off with just paying a bribe of 500 rs.
You can let him go if it gives you mental peace. You might think that it the right thing to do but if he knew he made a mistake he would have come to apologise instead of his mother. You might be his first victim but if you don’t make him pay, you might not be his last. He knew he made a mistake and he has to pay for it. -

Atleast if he came and apologised with you. You might’ve should think to leave the matter. But nah his ego didn’t let him.
And you have already suffered much bcs of this incident. It’d just a act of justice.
And take care yourself, don’t strain that leg and eat healthy foods too.

Please file the case so that his license gets revoked. Whether or not you get compensation out of this is secondary but for general public safety, do not let this man have the right to drive again.

Get an FIR done. If they want to settle outside court! ask for all medical expense + expense that will come due to her ability to not work + mental duress. a minumum of 5 lcs, nothing less.
Take them for every penny they have. Chappris need to know , actions have consequences.
I lost major part of my adulthood due the accident and i still feel i could’ve gotten better compensation.

The parents had resources to buy a bike(even on installments), but didn’t bother with a helmet and license? No sense of explaining him about do’s and don’ts on riding on road.Let them sell their bike if needed. Pretty sure their insurance will be void because the boy driving most probably doesn’t have a license.
Paying the medical bill isn’t even compensation. No one can really compensate for the pain and suffering and long term issue because of the plates. Why should only the person who got hit suffer and the person who caused the accident walk scot free.
He had the audacity to lie and claim that he didn’t cause the accident and even now he didn’t show up to apologise. Being poor is not an excuse for bad behaviour or lying.

As some of the other comments have mentioned, it’s all just drama, crocodile tears.
Ignore everything they say, if they act up. Get police over for intimidation and have them removed. Show no mercy. They’re not worth it.
The accident might be unintentional. But the way the accused and the family have handled / behaved after the fact is in no way showing a bit of guilt / innocence / concern for the victim.
If tomorrow I was in an accident, I will try to avoid punishment for sure but I’ll make sure and be concerned about the victim and definitely not behave like the accused & fam in this case.
It’s all just a show. They’ll show their true colours soon enough regardless of what you do. Trust me on this. Be firm. Ignore their requests and every single word they utter.

Your sister must be going through so much pain and anxiety . I was in a similar accident 7 years ago and still have the plates in my hand and am shit scared to get it removed. It has scarred me for life to the extent I never wish to go to the hospital no matter what. Not that I want it like that, am working on it. It is a trauma. Here is the thing, he doesn’t have any moral obligation to pay from his pocket because he has third party insurance. Why would some one pay third party insurance and then on top of that have to pay from pocket when something happens? What’s the point of third party insurance then?
You can file a case without feeling guilt, because nothing really will happen to the boy as the case will be fought by their insurance legal team and not by them. They probably are unaware of it. Just tell them to talk to their insurance people, and you can file a case. -

February 11, 2025 at 3:21 pmFile an FIR, possibly the insurance will not pay on his behalf considering he was violating multiple traffic rules at the time of accident but 2 lakh is a huge sum let them sell the bike put anything they have on mortgage take loans and recover the amount.Had it been an accident where the person was not violating rules then you could have shown some mercy but in this case he was a violator.
Also don’t take anyone’s word as fact most probably they are lying.

Because Any one can make a mistake and if thier finencial condition is not good (like living in basti, bike on installment etc) then you should understand and forgive him and ask him to pay half money which he can pay montly without much burden bcz after this situation his parent will curse him directly or inderctly bcz they are already poor and of new problem. I am saying this if OP and his family can afford the expenses. According to his condition, forcing them to pay full is not good (according to me). Show some mercy. If he is overspeeding and driving with his friends then you can ask him full to pay. I am not justifying but there maybe a case that he ran from that accendent situation bcz sometimes public take big wrong mistakes like beating the person etc etc. I am just saying that anyone can make mistake (if he was not overspeeding and raoming with his friends). -

That uncle never came out of the brain injury and passed away 3 months later. The biker shouldn’t have been let off the hook then and neither should the one who hit your sister. Please file a case!
