April 23, 2025 at 11:52 amSo hereโs the thing our family and the neighbours we have had two fights 3-4 years back but got settled as my family always opts for settlement rather than fighting in court, but this time the case is different
So this time my grandfather age- 78 was driving the car with my grandmother and when he was coming back there is a turn towards my house there was a dog who is have typhoid disease and he was fat because of this reason know the thing is my grandfather didnโt see the dog by mistake and he runovered the car on the dog and unfortunately he passed away but now because the lady in neighbourhood was looking for this opportunity so once she saw what had happend she immediately starting shouting at my grandparents and all and saying Ki ab toh Tum ruko tumhari bete Ki naukari khaungi Mai case krungi is baar toh and all . And immediately she took the body to the police station and filed the fir in the name of my father because of past grudges and all and circulated his no. To her contacts and now my father is receiving calls and all and know because of this now my family is taking stress and.
And my father has all the proofs that he was not the one in the car ,he was in office at that time and there are full proof cctv footages of that . Plus she even gave such news to Dainik Bhaskar as well .Now what are the legal actions that can be taken against her

April 23, 2025 at 12:04 pmIf you had a dash cam and cctv camera, then it’s fine. Usually (and sadly) such incidents are not taken as utmost priority in police. If you can prove that your grandfather was the one in the car, they’ll just fine him and most probably cancel his licence.-

April 23, 2025 at 12:41 pmYou prove your innocence and they counter sue them for defamation and ask for say 10x of your father’s annual income in return, I think your father is in a govt. Job so there is a provision of filing baseless allegations govt. Employees..-

April 23, 2025 at 1:13 pmBut my concern is also this that I am damn sure that she will repeat such things in future because of her malicious intent and we have a house here and same goes for her so we are not going to move from here to anywhere for a anytime soon and I donโt want her to give the liberty that she can file case just cuz she is having grudges-

April 23, 2025 at 7:57 pmHey, you can 100% take legal action against her under the BNS law. First, under Section 227 BNS, she gave false information to the police just to harm your dad, which is a criminal offence. Then there’s Section 230 BNS, which deals with filing a false FIR with the intention to harass someone.she clearly did that, and it can lead to serious punishment depending on the false allegation she made.If you win this case. which you likely will, since you have solid evidence like CCTV footage then after getting a court order in your favour, you should file a defamation case under Section 356 of BNS.
But if you want proper legal advice, then I need to know everything about this case, as your post doesn’t explain everything in detail.
