        Hi everyone,

        I was applying for a tourist visa to the Schengen region with the help of a travel agent cum visa consultant. They offered the service of booking the appointment, airline reservations, document preparations, etc. They made the appointment from their company email id, and when we enquired why our email id was not used, they intimated that it is the usual procedure they follow for all their clients. As the place we reside did not have Visa appointment center, we had to travel to a different city via flight to attend our appointment.

        All the documents they shared with us for our appointment was full of gross errors (including the covering letter containing information from other clients instead of ours). To say the least, they did a very sloppy job with our application. We ended up spending a lot of time redrafting the entire letters and supporting documents to improve its quality and correctness. Although this rasied a huge red flag, we didn’t go for much confrontation as our appointment was in their control.

        We reached the application center only to find out that they cannot accept our application as the consulate does not accept any appointment booked by the agent. This was also mentioned in the VFS website, which we discovered afterwards. From the email id they used, it was evident that it is of the agent.

        We lost a lot of money in travel and hotel booking at another place.
        Could you please advise me with the following questions:

        1. Is it possible to get any additional compensation other than they consultancy fees in case we go to consumer court?

        2. They are insisting that they will only refund the money provided we email them stating that it is the “full and final settlement”. Is such an email legally binding? Can we still go to consumer court after obtaining the refund this way?

        NOTE: They never provided any invoice or bill for the service.

        TLDR: Visa agent messed up our application and now saying that they will only refund this money if we agree that it is our full and final settlement. Would like to know if we can still approach the court for additional damages?

          Approaching the court always remain an option not matter what you give them. Better to there in person and collect money before you give this full and final
