Hypothetical question, is it possible to abort if you got to know the child will have downs syndrome? (Or a similar disorder)

Read an article somewhere that a woman was not allowed to abort (she was 20ish weeks pregnant) court dragged the case with tests after tests and concluded that there is no severe harm to mothers or child’s life and prevented abortion

Anything more than 20 weeks, you need to have the court’s permission. Which is why doctors stress on regular pregnancy checkups. Stuff like this can be detected as early as 13 weeks (3 months) of pregnancy

They should have done the down syndrome detection before 20 weeks. But as the article said 26 weeks old fetus so ofcourse court didn’t grant the permission.

The foetus was diagnosed via an antenatal confirmatory test at 22 weeks…The tests were reordered by the Supreme Court, which the family could only approach at 24 weeks, and were conducted at Mumbai’s KEM Hospital.…To add to this delay, the Supreme Court ordered another medical report, which was completed by the 25th week of pregnancy. During the 26th week, the Supreme Court passed its judgment.…

My understanding is- they approached at 22 weeks, but the process of receiving permission to perform abortion was dragged until week 26 (at which point they denied abortion citing the 24 weeks shebang). That is a result of inefficient bureaucracy for which the parents will have to bear the burden.

Its legally possible, MTP act allows you to terminate the pregnancy if

the child’s birth would harm the mother or

The child after birth will have serious abnormalities that it would suffer to live.

Till 24 weeks you can abort for any reason. Need only one doctors opinion till 20 weeks, and 2 doctors for 20-24 weeks. After 24 weeks abortions are allowed for only therapeutic or eugenic reasons for which a medical board is set up with a set of doctors and you need permission from court. Down’s syndrome is not necessarily a life threatening condition so it entirely depends on what the judges decide.

at week 20, there is a scan which is done just to diagnose downs syndrome, its done so that u can then take decision to abort or not, so yes its possible to abort , the process is designed as such.

So is it only able to detect at week 20 and not earlier?

If you are at high risk for having a baby with Down’s syndrome your doctor will advise you various tests like Amniocentesis /karyotyping / dual marker/ triple marker/ NIPT at 11-13 weeks.

There is a scan at 12 weeks called Nuchal Translucency scan or NT scan. The scan checks the thickness of fluid in the neck region and presence of nasal bone in fetus. This scan checks for Down syndrome (Trisomy 21), Patau Syndrome (trisomy 13) and Edward’s syndrome (trisomy 18).

God, a simple good search was all I needed. This case is from 2017 when abortion was allowed until 20 weeks. However the limit was increased to 24 weeks in 2021. Regardless, they were late according to law AT THAT TIME

I don’t know your background, But I am sure you must be aware these tests are carried out after each result which only mentions the probability & percentile.
Nothing is certain & lastly it’s will of universe, In my opinion don’t let it go so easily based on just mathematical statistics.
As these tests called as Double / Triple marker tests may or may not be accurate always.

Triple marker can be done as early as 10-12 weeks into the pregnancy. Taking my wife for the same in a couple of weeks. Wish us luck. 🤞🏽
