        Hey everyone,

        I need some legal advice regarding my situation with Cognizant. Here’s what happened:

        I went through the onboarding process with Cognizant on a customer service role(voice) but, due to personal reasons, I never attended office even for a single day. I sent an email to HR informing them that I would not be continuing with the company. However, they responded saying that since I was already onboarded, I needed to go through the resignation process formally. I did not follow up on this.

        Now, I have received a termination letter stating that I have absconded and need to pay ₹68,940 as per the notice period clause(my salary was 3 LPA). They have also warned of legal action and set a 7-day deadline to return company assets (which I don’t have) and make the payment.

        How I thought of Dealing with It:
        1. Negotiate with Cognizant to waive off the amount and notice period.
        2. Request them to reinstate employment so I can serve the notice period.
        3. Ignore the matter and wait to see if they actually take legal action.

        Has anyone faced a similar situation? What’s my best course of action legally? Can they really take legal action for a job I never actually worked in? Would ignoring it make things worse?

        Any advice would be greatly appreciated! Thanks in advance.

          Lawyer here. Haven’t personally faced a similar situation but one of my clients did. It didn’t end up adversely for him. Although we had to put in some work with correspondence through a counter notice and replies.

                Did you do any training? Ignore kr bhai, faced the same situation, i replied I don’t have money, plus i didn’t draw any salary, also what’s the point of notice period when I didn’t work a single day. They kept threatening eventually they left me, my sum was 50k.

                    Okay thanks a lot. Can’t tell kitna sukun Mila ye line padh ke. So I’ll just wait and watch what happens and hope for the best.

                        Yes I too was tensed back in 2021, but eventually they stopped bothering me, just wait and see what happens, pursuing this legally will be more costly for the company, I am sure they will leave it. Going to delete my comments now, chill biro

                      You didn’t work for a single day with them right?? Did they provide you any training or anything?? Do you have any clause of bond etc??

                      But most probably you can choose to ignore them but before that shoot them a mail saying that you have not attended office even for single day and due to that there is no dependency of you on anyone so there is not need of your replacement so notice period does not makes sense. Send that mail and ignore whatever they say.

                          Yup never worked for them. It was a mass recruitment so there were 1-2 virtual meetings other than that no training and I didn’t even collect the laptop.

                              Don’t respond to them. Don’t engage with them. Let them send the legal notice. Don’t respond to that either. For 68,000/- rupees no one will spend more on a lawyer to recover that from you. Empty threats.
                              Lawyer up only if they actually file the case.

                                  IT employees do this all the time.. keep multiple offers and join only one org and abscond others. How can they do this to you
