April 15, 2025 at 1:35 pmI (21F) live with my mother and elder sister. My father has a history of domestic violence, cheating, and financial control over our mother. My mother has been working for 25 years, but all her salary was either credited into his account or handed over directly to him.All property and assets are in his name, except our current house, which is under both my parents’ names due to a builder’s mistake. The home loan for this property is being repaid entirely by me and my sister for the last few years. My father hasn’t contributed anything.
We found proof of him engaging in extramarital affairs, and he has also physically assaulted my mother multiple times. A police complaint has been filed, and he was warned by officers. He also tried to harm himself after being confronted. We have video proof of him leaving a hotel with another woman and call recordings from before.
Since then, we’ve refused to let him enter the house, but he frequently returns and stalks us. He sleeps outside the main door when I’m away, despite prior police involvement. This has made our living situation unsafe and extremely stressful for my mother, whose health is deteriorating (she was recently hospitalized due to high BP).
We cannot leave the house since it’s the only asset partially in my mother’s name. He is refusing to file for divorce, and we believe his intent is to wear us down financially and emotionally.
What we want to know:
1. How can we legally stop him from coming near our house or harassing us any further?
2. Can we file for a restraining order or protection under the Domestic Violence Act even though he doesn’t live with us anymore?
3. Can my mother claim exclusive residence rights, considering she co-owns the property and is being harassed?
4. Can we claim maintenance, share in property, or protect ourselves from being evicted later?
5. Any way to expedite divorce or protect ourselves if he delays it intentionally?
We are willing to share all available evidence if needed. We are currently financially strained and cannot afford high legal fees. What are our options?
