Employer forced me to resign over a call and paid decent severance of around 6 months.

This happened last year and was supposed to be confidential. I have the call recordings for the meeting. I am settled in another job now.

What legal action can be taken here? I want this practice to be stopped in Indian companies.

While forced resignations can be challenged under constructive dismissal laws, accepting that 6-month severance package likely complicates your case. The recordings are good evidence, but signing resignation docs + taking severance means you technically “agreed” to the terms.

Quickest path forward? File a complaint with the Labour Commissioner. They can investigate without you diving into lengthy litigation. But being honest — with decent severance received and new employment secured, courts may not prioritize your case since you weren’t left hanging.

Just check any NDAs you signed during severance first – some have clauses restricting legal action. And definitely talk to a local employment lawyer for specific advice on your situation.

Not formal legal advice, just sharing my experience.

I did sign an NDA. That was the precondition for the severance. I was under so much pressure and in shock that i did everything that they asked for.

I think they have all their bases covered and nothing can be done.

NDA signed under duress are invalid. But you still need to prove there was duress.

Well said.. OP taking money has diluted the case..plus he says severance was decent !..legal case will take 20 years and will drain out the severance received..move on !!
