https://www.reddit.com/r/LegalAdviceIndia/s/ODmsBAj24kBrother and his wife have moved out to their own apartment after 10 months of marriage. This is an unhappy marriage, both of them are incompatible but SIL is in denial.
My brother wants out. However, SIL is okay with an unhappy marriage since she is afraid of society and divorce.
Other updates –
– Brother pays full rent and bills. SIL is supposed to pay for house expense (food, maid), she only does it sometimes.
– From what I have read online, pls advise if these grounds are correct –
— Irretrievable differences
— Mental cruelty
— My brother is feeling depressed. Idk if that counts as ‘unsound mind’, does it?
— SIL had herpes for a month, which is an STI, does that count in ‘Venereal Diseases’? Don’t know how she got it.
— Not sexually active
— SIL’s brother (30m) seems to be mentally retarded, we don’t have proof but now that we have interacted with him regularly, it seems like it. She has always dodged this topic whenever my brother has asked her. I fear the condition(if present) runs in the family and they are hiding it.If my brother moves out again to live separate (at my parents’ house) while also paying the rent for new house (where SIL lives) does that count as seperation? How long do they need to live seperately for it to count in court?

But judgements in favor of men have been a deadend street.”If it is genital herpes, venereal disease counts. Especially if your brother does not have it. It could also be used as mental cruelty (I.e. wife asking for sex during an outbreak- HSV has no cure).
Separation counts if your brother moves back to parent’s house. Just have CC installed to counter any claims she may make.
You cannot do anything about your SIL’s brother.
