        After years of dating and marriage, my wife and I are headed towards a divorce. We both have full time jobs in the US and no kids. We got married few years ago in India which was ceremonial only as we could not get it registered. I am wondering as the marriage was never registered, is getting a divorce really required? If yes, will our individually-owned assets in the US be subject to divorce settlements? What can I do to ensure my family’s assets in India stay protected? Any advice would be appreciated.

          marriage ritual is legit marriage in india. get divorced in india as well

              1. Yes, you have to get a divorce decree from the court even if your marriage is not registered.

              2. If you are going for mutual consent divorce, you both will decide how your assets will be divided between the both of you.

              3. If you are choosing to get a divorce done in US make sure your wife also actively participates. In other words, don’t go for one-sided divorce. If your wife has actively participated through an attorney/ counsel, then that decree will be held valid in Indian Courts/ authority.

                If the ceremonies were performed, marriage is considered valid in India, irrespective of registration. Since you guys are headed for a mutual divorce [if I understand correctly], you can mutually decide as to who’ll get what. It’s the best way out. The process is also easier, divorce will be granted within 6 months or lesser.
