        Hi, I need legal advice regarding my notice period situation.

        I have worked at my current company for 2 years and have recently resigned because i got new offer. My notice period is 60 days, and I requested an early release, but they refused. I have no tasks assigned, I’ve only fixed 3-4 minor bugs in the last month, and mostly I’m just sitting idle.

        The new company wanted me to join immediately, but I stretched it to wait for 45 days, hoping that since I have no work, I might get an early release.

        My joing letter states:
        The notice period for leaving / terminating services shall be 60 days on either side (can be immediate
        effect from our side).

        I want to know:
        – is there any way I can leave early without completing the full notice period?

        – Can they withhold my relieving and experience letters if I leave early?

        Any advice on how to handle this situation would be really helpful. Thanks!

          Only option is to negotiate with your company to release early.

          They can withhold your relieving letter, F&F if you abscond. Even if you manage to join new company without relieving letterΒ  EPF will have overlapping employment leading to serious issues later.Β
