February 16, 2025 at 6:44 pmI ordered a product on Amazon for โน2,699, but when I received it today, I noticed that the MRP printed on the box was โน2,299.When I contacted customer service, they explained that the price on the website didnโt include government taxes. However, this doesnโt make sense since the MRP itself is โน2,299, which should already include all applicable taxes. This means I was charged more than the listed MRP for the same product.
Although I have returned the item, is Amazon allowed to charge taxes above the MRP?

I’m also a seller on Amazon amd many sellers do trading of products there, rarely few manufacturers in online marketplaces who sell.No one can tax more than mrp as mrp is an all inclusive price. Amazon actually charges heavy commission on products as sellers ship throughout India in over 17000 pincodes.
For item worth 2,699 Amazon might easily be charging 250+ rs on shipping and handling. Besides, since I mentioned trading, the seller might have purchased the item on mrp or slightly lower (can’t comment as you didn’t mention product) so seller is marginally profitable on selling item over mrp .
Also if you’ve returned the item it is a loss for seller as they will have to pay for shipping twice now one for delivery and the other for return. Amazon is strict in this case.

February 17, 2025 at 3:30 amHey, now that I think of it, I think the seller is just selling higher than MRP to make up for the amount lost to Amazon in commission.Have seen restaurants do the same on Zomato/Swiggy.
However, that is still illegal to sell above MRP.

February 17, 2025 at 3:54 amSince the reddit or has returned the product to the seller I believe the amount gets refunded within 5 to 7 business days. Also if the return item of that sku is more than 5 times the item gets delisted.If seller cancels order more than twice, their ID gets banned for 14 days and permanent ban if issue is serious.
Also, selling above mrp or actual right price is a common case among many sellers on Amazon and flipkart as commission is as high as 40% on some products so even a 100rs product is selling for 400rs in these marketplaces.
Better you look for blinking, zepto, instamart etc. Commission is very low and immediate delivery.
These are some unethical tips from a seller might help anyone who is wondering why they sell above mrp.
On a side note, never purchase branded items on Amazon search for these items on their own website example puma shoes usually have better offers on puna website.

Honestly, I can file a complaint etc. but is it really worth the time? I have placed a return request anyway.

February 17, 2025 at 3:03 amAs you have already placed a return request, I guess your personal issue is taken care of. But the larger issue remains, charging above MRP. You can post it on Twitter, your bill and box image, you should redact your personal information though. Tag Amazon India, Amazon USA and Legal Metrology Department. Charging above MRP is a criminal offence under Legal Metrology Act.You can file a complaint online aswell as others have suggested.

But first need to see sales invoice before building hopes. If price under product HSN is sold and customer was denied for refund it is huge to sell beyond MRP, but if thats within MRP and other charges are under different head like shipping or processing then its compliant.-

If amazon is charging high, it can be as a service fee or platform fee with applicable gst, cannot be under same HSN of product being subjected here

RESOLUTION: We would like to inform you that, effective from January 1, 2022, Zomato is required to issue tax invoices on behalf of restaurants for items listed under “Services” on the menu. In your restaurant bill, taxes were not included, which made it necessary for us to charge 5% tax on the item value and 5% tax on the packaging charges. February 17, 2025 at 10:29 amUsually they refund the difference, once I ordered SSD for 7k but it came with its original packaging of 3.5k I raised the request they refunded the money after deduction of promo card offer, no prob with me as in the retail market too SSD was around 7k that time. So it’s a win win.
You can tell them you are going to file a consumer case in which they will loose poorly with giving great benefits over and above to you or simply they will refund the difference if someone sensible comes on the phone for conversation with you.
