UMarried my wife a year and half back. She has been suffering from mental disorder especially severe depression and personality disorder , since 2020 apparently. However, this fact was completely hidden from me before marriage and only half truth of depression was shared saying it was all healed after 2-3 months of minor anti-depressants. We both reside in Mumbai.
Within 2 months of marriage , I realized that her illness had been chronic and more severe than told to me. Also, she had been on anti-psychotic medication additional to anti-depressant in her past. I was not at all aware of the anti-psychotics. She had also attempted suicide in 2020 (confession verbally) which was completely hidden from me by her and her family.
During this year, although my marriage is consummated, it had been a hell ride where she has a severe mood disorder and my life revolves around her mood. She has been failing in marital duties as a woman with some exceptions depending on here mood. Also, highly disrespectful and verbally abusive, bitching about my traditionality and my parents. She also has been critical about my sister. My wife works in a financial firm and somehow has managed to have good impression outside the home and hide her true self. Whenever, she gets mentally sick, she manages to avoid work and people and harass us expecting us to take care of her. She lives with me with my parents in the house.
During this marriage period, she has been physically and verbally abusive to me multiple times. I have audio recordings, video recordings and also pictures of her abuse of me. I also learnt that she had been given major psychiatric treatment in the past in a Mumbai hospital including electric shock. This was before marriage and also recently when she attempted suicide at my home due to her mental illness (I have police report). She does many times remorse her actions but suddenly flips and starts blaming the whole world with false accusations on me as well.
I do have many evidences with me of cruelty . Her parents are also aware of this condition but are showing helpless. She has attacked them on multiple occasions as well.
1) Should i go for annulment or divorce?
2) What if she doesn’t agree for divorce due to spite? Does a mental condition allow her parents to sign on her behalf?
3) If contested divorce, how long am i looking in Mumbai family court?
4) Is there a provision of ex-parte decree based on the seriousness of her mental condition and video evidence I have of her domestic violence?
5) How much does it typically cost for such divorces?
6) What can i do to protect my parents and sister from false accusations she is threatening?
Any help from this community is highly appreciated.
