I am shifting to a new apartment with the house on 5th floor. My society is giving me a couple of rules which seems illegal can you advice

        a. Upfront payment of Rs. 5000 for using the lift for moving items into the house

        b. Furnitures can’t be carried in the lift and have to be carried on the staircase till 5th floor.

Unless you own an apartment in that society, you don’t have to worry about these bylaws. However, if you’re renting then contact your landlord and do what he says.

These rules specifically address the tenants. Wouldn’t I be penalized if I don’t follow it?

Contact your landlord and get clarification. If still not clear, get a lawyer for further clarification

If it is new construction and still the society is not registered with muncipallity then its illegal and if its registered with corporation with they can make their own rules but you can negotiate and if you are a tenant ask the owner to follow and if you own you can ask or communicate with other residents/tenants how they have shiffted their household items

Engage with Society Management: **Open a dialogue with society management or the residents’ association. Express your concerns politely and seek clarification on why these rules exist.**

**Restrictions on Furniture in Lifts**: Prohibiting furniture from being carried in lifts may be intended to prevent damage or overloading, which could lead to costly repairs. While this rule might seem inconvenient, it could be within the society’s rights if outlined in their regulations.

Ultimately, understanding the rationale behind these rules can lead to a more amicable resolution while ensuring compliance with legal standards.

These rules are quite common in societies all over India. Nothing illegal about this.

that’s called move-in fees but asking 5k and then not allowing to use lift for furnitures is bad, they sud ask less in that case if they don’t have a service lift.
