        In 2023, due to repeated harrasment and threats I filed an FIR against a person living in my building. They filed a fabricated FIR against us in return. The statements given by in that FIR do not explicitly mention my name and has inconsistencies that can be easily seen. Now I have received an offer to study abroad and have to leave in August but I cannot leave as of now due to the pending case against me. The lawyer i hired said getting an exemption is the only option. And after taking 40k in fees he is doing nothing. What options do I have? Will provide any details that are asked in the comments.

          You need to change your lawyer. Not all lawyers are like what you said. When you mean “he is doing nothing” what did he not do?

              He is not presenting arguments in court. He is not proceeding with exemption.

                      No, i went to him through a reference. Do people from legal aid charge 40k? (Genuine curiosity, i dont know about legal aid)
                      Also, if i try to find a new lawyer, how and where do I find a good, non-exploitative lawyer?

                          Usually free legal aid lawyers don’t charge. They charge only for paper works as far as I know. It varies from jurisdiction. You need to ask around where your case is listed

                              Lawyer here based in Delhi. Im not sure what does your advocate mean by ‘getting an exemption is the only option’. Depending upon the facts and circumstances, you ideally would have to seek permission from the court to travel abroad. Although im guessing that it must only be a complaint and not yet an FIR. Even if its an FIR, it must be registered under Non cognizable offences so hire a smart lawyer who could settle this matter once and for all.

                                  By exemption – I believe he means that she would not have to appear in person for each hearing etc.

                                  OP- file for quashing of the proceedings of the FIR (if there is a FIR). A criminal case on your record will really hinder your prospects in the country you’re going to and will be constantly flagged in a criminal check.

                                      How long does the quashing process take? Does it require the presence of both parties?

                                          It depends. Honestly no one can give you a definite timeline for our judiciary. No – now it is you v. The state (represented by a prosecutor). So yes – a representative of the state and you would be present (unless you’ve filed for an exemption)

                                          You can’t keep filing exemption applications successively. Warrants get issued. So that’s not a permanent solution.

                                                Chargesheet has been filed. quashing hasn’t been filed because out of the 4 lawyers I have visited so far, none gave me this option. Also, i am not sure but i think both parties are required for quashing? The other party already has several cases against them and are absconding

                                                    The Bee movie defines lawyers very accurately. In that movie a mosquito is lawyer of animals, it says, I am already a blood sucking parasite, to be a lawyer all I needed was a briefcase.

                                                      Yes mine also scammed me. Took 1.5 Lakh rupees for me and never submitted it to court and lied and cheated. Referral again .
