        I have a huge sum of deposit that is yet to be paid by my previous owner, states he’s got more than 40 flats around the area, he owns most of the flats ( I highly doubt that because it seems it’s being run by one of his relatives, it seems to be a cohort), he’s outright threatened me to file a case and see what I can do about getting my money back. Anyone who’s faced this or anyone who’s a lawyer who can advise?

        The deposit has been paid via online transfer, I have all the evidences. I have the video of the flat while leaving as well, I have the agreement but it isn’t a notarized one since usually before 11 months it isn’t necessary for the owner to get it registered with the sub registrar magistrate, but there’s one that exists and clear communication that it is binding.

          You can kiss your deposit goodbye. The best you can do is to ensure the flag is to damaged that it costs more than that.

              I intend to file a civil suit and eventually a Criminal case for Fraud, but that would still mean my money doesn’t come back for a long time

              Lawyer here, well notarize agreement in not exactly necessary but you should read the agreement and clause that concerns the security deposit and after that if you still feel you haven’t done anything wrong then contact a lawyer, send a notice and initiate civil proceedings. In most of the cases people know what they are doing wrong and just the notice or summons might be enough to get the money back.

                  Thanks a lot that helps, I have all the videos, everything is left in top state, neither the paint is damaged, he’s simply trying to strong arm us

                      Yes it seems that way, try contacting a decent lawyer and send him a notice, it won’t be very financially draining.

                          Another question, the agreement is like really just a pdf copy that he’s shared over WhatsApp, not even on a stamp paper, does it count as a valid document in court? And even if it doesn’t, that might just mean that the owner is in more trouble because that spells fraud?
