SMe and my brother have long conflict due to his greedy nature, long story short i’m only successful person in my family and my brother do not earn well(less than 30k/ m) so my mother sympathies and support him blindly in every step, they want me share in my own earned property. Now recently when i told my mother that i’m moving abroad, my brother and mother together stole all my education, house registry in my wife name, bank documents cheque and passbook every single document stored in in my locked almirah drawer just a day before my flight. I have tried police complaint but police is not helping but now i’m in uk. What action i can take to recover my documents from UK i have cctv recording of him walking with documents outside of our house and handing over to his friend in car.
Please provide legal advice to recover documents and if not able to recover how do i get home registry reissued, i have digital record of all documents. -
AJust by taking documents, there is nothing he can do with them. You are well within your rights to get a copy from the registrar office of your house registry plus whatever bank documents you have, the bank can replace them as well.
I would just sit back and work on these channels to get hold of replacement documents. File a FIR for lost documents so you have it on record that these docs were actually stolen if at all he ever produces them for whatever reasons.

HIf the documents are with his friend, use the cctv footage to scare him also try to get his name mentioned in FIR make sure he knows about this, 1 call from Police and he will shit his ass.

IIs there any inherited property?
If so tell them you are not going to sign the inheritance, and that you will put a case in court so that that property will be stuck in cases for 20yrs, unless you get your documents back. That should scare them.

MAsk your in laws to visit the SP office and register a complaint there saying local police are not filing the FIR and not aiding the matter. Local police will be forced to help in that case. Take a lawyer if they are bit afraid. Don’t leave such things as one off, that will just make them bold enough to attempt something even worse than that the next time.

WForget the legal recourse. Start the process of blocking and generating new docs.
The property docs can get got again from SRO office. It is a cumbersome process and will Cost bit but get a lawyer and get this started. You will need FIR stating theft/loss and then there is a process which takes 60-90 days.
File a case. Block your accounts.
Education certificates – mail to the colleges. -

NWhat documents are these? There’s nothing your brother can do if the documents are legit in your name especially education or property related documents. I’m not exactly sure what your brother is trying to do here, but you don’t have anything to worry about. Like others have pointed out, you can always get a replacement document for everything as long as you furnish identification.

DDude, sorry to hear your story but those are just documents. They have stolen something much more valuable and sacred which is your trust and relationship….
you ought to be concerned more about that but it seems pointless now anyways that the damage has been done…very sad…
you can always get legal duplicates of any documents and it is a bit of a hassle but can be done with help of a lawyer and filing a FIR…..also put a block on your bank accounts so that they do not misuse them….
If you are open to it, sell off the house to some powerful person as he can handle evicting them from the house and you will get your money….

SHi a lawyer here. Depending upon the facts you stated there is a case of theft to be made out here. However where goj are based is an essential condition in filing cases and actualising them in india. May i ask where did this happen? In which state/city.

SJust tell em you will get duplicates made eventually, however if they do not give the documents back in an hr they loose your support permanently, also tell your bro that don’t thinkhe will get parents property, even a will can be challenged in court by siblings, and you will make sure all assets are stuck in cases for decades

the best remedy would be to file an e-fir against your brother and mother and then file a protection petition in high court, seeking protection from your brother and mother, as they can misuse your documents which can likely cause a lot of trouble to you and can even ruin your life and career.
Also sent a hand written complaint to the local police station, Dy.CP and Commisioner of Police.
As they have your property papers, stay on any sale and purchase as they can create third party rights by committing fraud, but anyway won’t be able to get the property transferred. Also you can get certified copies of your documents from the Sub registrar office of your jurisdiction.

if legally kuch nahi toh bhai publicly bezatti kar de. Bhai jidhar kaam pe hai udhar jaaa ke tamasha and all. Sometime u need to stoop to their levels. Just make sure u are not alone and someone is recording on their phone. Try to steal it back and if u cant then steal something of theirs which would make them want to exchange it for ur documents or call the police which then will let u have ur stuff back. Baaki toh gunde log leke aaja bhai not to beat him but to intimidate. Try to take documents or jewellery of ur moms or ur brother’s which would finally prompt the police to take action. Make sure not to get violent/physical and dont get caught saying something threatening on the phone/cctv or other people like neighbours/colleagues.

UMy dad is the only successful person from his family and we lived abroad. Once we came on a long vacation and got my brothers passport renewed and my uncles hid it (my dad let them live there since we weren’t here).
Only after filing a police complaint did they return it. There have been other instances of stuff like this. It happens more often than you think.

CJust block all the cheques and don’t get them reissued, hire a lawyer who will help you get the copy of property papers and may be re made, it took me less then 3k my sister ripped the papers when I refused to share. File a lost FIR for your education documents and get them reissued and you are done. Fighting your family is more of a headache especially when your sibling is a worthless piece of shit
