UWe are building a house. Our builder was a genuine fellow and always did his work after we paid his money stage by stage. But, at the last stage, believing he would follow through as planned, we gave him full money for tiles and painting. Now, he is showing his true colors, not picking up calls, not buying tiles, always telling us this week we will buy, and demanding more money every time we meet with him. It has been two months and he hasn’t done any work for the amount that we gave him, around 3 lakhs. What should I do? Complain to the police or file a case in court or wait it out? We know the area he lives in and so it is easy to find his house. What is the procedure to get our money back or to get work from him.

DHello. It’s disheartening. Nobody should be cheated on a house, it is very hard money after all.
You should first check if the project comes under RERA. Go to your state’s website, searxh for the project. There are ample remedies under the act. Then you also have remedies, such as specific performance and money recovery.

Get a lawyer, file an FIR, if they don’t add everything to your chargesheet, file a complaint in your civil court and keep it simple. Focus on retrieving the money, not making him construct your home. Get all transaction proofs.
It’ll mostly fall under civil case so no point waiting for the case to be finished. Get a new worker.
Ask the lawyer if he can manage to make it into a criminal or harassment case which can push him to settle quickly.
