Can a person released without a surety?

Today, i encountered a situation where a person took into police custody for violating a public declaration (Unintentionally). The person whom being took into custody is poor, helpless, and started a very short time business with 5/10k only and police came to his shop and took him to police station and told him for surety for his bailment, but the person dont have any person whom have any kind of necessary documentation. What type of remedy is available in situation like this?

Get him lawyered up for free of cost from District Legal Services Authority. Rest the advocate will do.
