April 5, 2025 at 12:40 pmI had an account with a bank, which I closed as I already had accounts with better banks. During closure, I noticed a Rs. 20 deduction for PMSBY, which I never enrolled in.I raised this issue on Twitter in June 2024 and sent a formal email to the bank 9 months later (March 2025), requesting proof of my consent or application form.
The bank did not provide the requested documents by email. Instead, 10 days later, four representatives visited my home and tried to persuade me to withdraw the complaint. They failed to provide the documents again, so I demanded compensation for unauthorized enrollment and their failure to share the information.
About 15 days after the visit, I received an email accusing me of blackmailing the representatives for money. It also mentioned the documents were moved due to space issues and threatened legal action unless I withdrew the complaint.
Below are some of the extracts of what the bank wrote in that email:
*Our staff visited your residence for the confirmation but you threatened and asked them for Rs. XXX/- as you said that you have also got from XYZ Bank, otherwise complaint will not be withdrawal which is Self- explanatory that you have started blackmailing with an intention to collect the unlawful money.
You are requested to withdraw your unlawful complaint or send us the reply that why not legal proceedings should not be initiated against you for blackmailing and threatening to government institution.*
Personally I’ve never seen any bank being this unprofessional that too on an official email.
Therefore I would like to know what are my chances of winning this case in an RBI complaint (which I have already filed as of now). And does the bank even have any grounds to file legal proceedings against me for blackmailing (compensation request)?
Thanks in advance.
PS: kindly do not ask any personal information as I will not be able to provide it due to privacy reasons.

April 5, 2025 at 12:48 pmYes. I’ve already filed it. I am just surprised that the bank (branch head actually) had the audacity to accuse me of blackmailing and that too via official email.-

April 5, 2025 at 12:52 pmI meant I’ve filed RBI complaint today only. No previous complaints regarding this was made by me in the past. Let’s see what verdict gets passed. Will probably update my post as well.

April 5, 2025 at 12:51 pmHello..Not a lawyer but I faintly remember a similar case.1. The burden of proof for the PMSBY is on the bank and failure to generate the log for the same with your signature can be used as an advantage.
The bank officials may forge the document.
2. Bank officials do not visit a customer without a formal notice and/or written instructions.-

April 5, 2025 at 12:56 pm1. That is what I fear. Because if the bank provides forged documents then BO will most probably close the case on bank’s favor.
2. I did got a generic response that branch representative will get in touch with me. However, sending four representatives at the same time is not justifiable.-

April 5, 2025 at 1:47 pmYou can raise an additional request to the ombudsman to officially seal your documents till the investigation is complete.
A lawyer can help you with the rules which you can ask the ombudsman to follow as your previous explanation suggests that this certain bank has already done reverse blackmailing.-

April 5, 2025 at 2:00 pmThank You. I’ve filed a complaint with BO but do not wish to go the legal route as of now. I might however do it if I do not get a satisfactory resolution.

April 5, 2025 at 3:09 pmYou will win money . I am wondering if they repeatedly fail to provide the documents can a case of forgery be filed !!-

April 5, 2025 at 3:20 pmThat is what I’m worrying about. They may tamper documents and frame their reply to BO in a way that favors them. I’ve filed the complaint to RBI today. I am hopeful of a positive resolution as the branch gave a really unprofessional email threatening me of legal proceedings if I don’t withdraw the complaint, a clear case of intimidation.-

April 5, 2025 at 3:32 pmIt’s not a new thing. Refer to the below article of that is similar in nature to mine. I am not sure whether they actually forged it or not but I certainly never gave my consent for the enrollment. For now I’ll wait for BO’s reply and then will decide my next course of action.[Bank told to compensate customer for unauthorised debit for PMSBY scheme

April 6, 2025 at 12:45 amHave you received monetary benefit from another bank already as you are saying claimed by the Bank ?-
RRapidrushabh1938
OP
April 6, 2025 at 3:23 amYes. I’ve received compensation from banks after escalating the issue to Banking Ombudsman. However, those are completely different issues and nowhere related to PMSBY. This bank has misrepresented my statements from the home visit and framed it as if I’m trying to extort money from them.
