        Hi ,

I had taken a loan from payday loan company called Daytoday loans. At the time of application I had given a cheque.
After clearing the loan, when I asked my cheque back, there are refusing to give it back and not responding my messages/ mails.
Can I file a case against them?
        Please advise.

        Thank you

Do a stop payment on your cheque.

Cheques have a validity, if it’s beyond that period, just forget it, there’s no harm for you here. Banks/NBFC can take a cheque from you towards repayment if not done. If you have already cleared your outstanding, just tell your bank to hold the cheque if it comes for clearing. Ask for a NDC from the loan company through their nodal email or grievance email

I think cheques have a validity of 6-12 months and when giving blank cheques you need to mention it as canceled so that cannot be misused in future. Yes you can file case with police as well as the lender and with RBI ombudsman

Rather than taking the legal time consuming route, just activate stop payment for the cheque that you have given..
peace of mind is more important than filing a case and breaking your head.

Just mail bank to deactivate specific cheque nos, and loan company you have cleared the loan so please destroy cheque in there possession or return to you. Otherwise they will liable for future misuse of cheque.

Stop payment of the cheque in your bank. Inform them on mail attach a copy of your loan closure NOC and tell them that the cheque is no longer valid

Hope you have the cheque number or a photo of it. Issue a stop cheque instruction through your bank.. that checque will be worth nothing

No need to file a case, waste of time, money and ofcourse headache
