I work at a startup in Bangalore. There are certain personal issues between me and my manager, however I’m very sure that my work is up to the mark (in fact better than most others in my team). If the manger gives me a poor rating in appraisal, can I make a case against the employer or manager as per the Indian labour laws (whether complaining with the labour commission or filing a court case)?

Please note that this is not a discrimination based on caste, relegion, gender, etc. So, does article 15 (or any other legal provison) protect us against other types of discriminations as well, like personal bias or discrimination due to personal rift between me and my manager?

Can you prove your work is better than your peers? Do you have empirical evidence?

No, you can’t. You need proof with proper numbers to compare.

Appraisal is not always objective. The decision is subjective. So, it’s hard to prove discrimination.

Quit and find a new job.

There is no discrimination. It’s just you and your manager don’t get along. Just switch job for better CTC

Not getting along without any reasonable explanation (or without any fault of mine) is it not discrimination?

Nope. Thatโ€™s what not getting along means.

Maybe you can shame the manager name here, on telegram groups, in developer meetups, so that he becomes unhirableย

The only route would be to report in the organisation. Better way would be to change project within org or switch . Life is too short to fight needless battles.
