January 24, 2025 at 5:48 amI was sexually abused by my uncle (Mother’s brother) from 9 years, and it continued till 19 years. After my 10th class, He started blackmailing me and forced me to prostitution. He used to take me every day from college around 3 years before going home. My both parents are working professionals, and they don’t have any idea about my issues. I’m 24 years and working in the USA. I left India and thought I’m safe now, but he started calling and abusing again through phone. I’m under therapy for 2 years. I thought i”ll get peace and a normal life once I move out of country, but I really think I need justice and may be that’s how I can move on and start a new family. Is there anyway I can file a case through pocso act? If not, how can I proceed? -

January 24, 2025 at 5:55 amNot an advocate. I am sorry you are going through this OP. Yes you can.. Guess you should give a formal complaint to the police station that comes under your address. They will try to downplay it but stay strong and proceed with it, once you file an FIR, then you will have the regular court visit and also you will have to give your statement to the magistrate personally. -

January 25, 2025 at 6:34 amAlthough, the Act came into force in 2012. The offence of sexual assualt, rape etc. existed prior. Therefore, the bar of Article 20(1) is not applicable.-

January 25, 2025 at 6:35 amBut they can’t be punished according to provisions under POCSO right? Pocso is more harsher and specifically focusses on crimes against minors? Am I right?
