Last night, my mother was harassed by a family member who attempted to break her door and force entry into her home. Despite her efforts to seek help from the police, they refused to intervene, dismissing it as a “family matter.” My mother is the legal owner of the property and lives alone.

The individual trying to enter claimed he had bribed the police and that we were powerless to act. In response, I tweeted to the Mumbai police, alleging that the local authorities were unhelpful and only demanded bribes.

Later that night, when my mother visited the police station again to request an FIR, they refused to register it and threatened to file a case against her unless she wrote an apology letter for allegedly defaming the police on X. She did not comply or write any letter. I have since deleted my tweet on X (formerly Twitter), which was live for about an hour.

Given these circumstances, I am concerned about whether the authorities might pursue action against me as technically I have no proof for the claim on X.

Also, can police refuse to file an FIR for family matters ?

For context, I have been living in the UK for three years and am no longer residing in India.

          >whether the authorities might pursue action against me

No. Don’t worry. You made a general statement without specifically mentioning the police personnel. No case can be made out.

          >can police refuse to file an FIR for family matters ?

No, not all. Domestic Violence is a crime. There are multiple avenues that can be explored. After police refused to file FIR, then try SHO(head of the PS). Then can approach DCP/SP or file magistrate complaint. Also, concurrently approach the women commission.

Well this gets me nervous because I did tweet the police person who visited my place’s name, but I didn’t mention about him demanding a bribe. It was – XYZ is not helping. Police asking for bribe.

Two different sentences, open to multiple interpretations. Criminal laws are STRICTLY interpreted i.e. only ONE meaning can be made out of the impugned statement. So NOTHING will happen. Relax.

They can file an FIR but they can’t do much else. However, you have the option to complain about the police to his higher ups and you should.

This is what happens in this stupid corrupt nation. We try to do the right thing without other intentions, again get fearful of the lawmakers and police. Pathetic country

Best thing to do is get number of your local station senior inspector, call him up and explain situation and offer him suitable compensation for his and stations help in this matter. You are stand to lose 25k at least but your relative will not bother your mother again.
