        I don’t know where else to ask, but I really need some guidance. My family is stuck in an ongoing legal battle—my sister’s divorce case, which involves domestic violence. The person she is fighting against is in the police force.

        Every time the case in court takes a turn against him, he retaliates. My father was attacked. The police found the people who did it and linked them to him, but nothing happened. He continues to misuse his position to intimidate us, and it feels like he can act without consequences.

        We are living in constant fear. The legal system takes time, but does that mean he can keep doing this forever? Is there any end to this power abuse??

        We filed complaint in state govt system too the inquiry went to him and nothing happened just more police at our place.

        If anyone has faced something similar or knows what can be done, I would really appreciate any advice!

            Write to state human right commission.

            I am not a lawyer but I have multiple news where common people have fought against IPS by taking them to court and human right commission.

                Get a good lawyer and file for anticipatory bail for all members of the family. Police officers can’t arrest anymore. Also, try to present the case to the judge where the police officer misuses his authority. He might request suspension or transfer. Some judges are good and not a fan of police departments.

                When the police is after you, only a lawyer or a judge can help you. Police fear them.

                    Anticipatory bail? For what?
                    He can’t file fake cases against them because they already have a 498a domestic violence case against him.

                        Here the suspect is an IPS officer. He has a lot of police stations under him and can persuade any SHO to file false charges.

                            Arrest without warrant is only possible in cognizable cases and non bailable cases ( serious cases ) .
                            Here even if the SHO files an fir ( by ips ) , how it can be of grave offenses and no arrest can be made without permission of magistrate in such cases , it is obvious now that they aren’t going for cross FIR rather adopting the method of intimidation and harrasment to settle down the matter.

                          Arrest for what ? And anticipatory bail ? I did not get a connection. From when victims need to apply for bail instead of accused ?

                          If you do have video and audio proof then send it Higher officials to Police department along with the Home Minister. What it may help is he may be transferred or suspended for such period . A departmental inquiry may put him in trouble for such Dometic violence case . Civil service rules clearly does not tolerate such act .
                          Keep doing other legal work as well.

                            IPS people are untouchable. I am sorry your sister is going through this but ask her not to lose hope. She can single-handedly ruin the.giy’s life if she chooses to go ballistic on his ass.

                            Be brave and know that she will come out on top.

                              Gather as much evidence you can and go to the NCW. If that doesn’t work, then post all the evidence on social media.

                                Your lawyer must raise the issue of intimidation and attack in front of the judge , clear ground against him imposing threat to life and property.
                                What kind of lawyer you are having.
