USo i recently came across a friend who is a starting law. He told me of a case where a man was gathering evidence of his wife having affair using a private investigator and through social tools and cctv cameras.
He collected all the chats, photos and videos.
He somehow violated some privacy thing and is about to face upto 5 years in prison!
He added if a woman were to do the same on her husband it wouldn’t be a problem.
I mean, is this true?! is this justice?! wtf I’m really scared… please someone clarify -

USo he was accused for a criminal charge right? Right to privacy if not a criminal charge. But it can apply to criminal cases of other charges. I am assuming that the wife filed an FIR of stalking
depends on how he collected the evidence. If he stalked her to the point that she apprehended danger, the stalking laws would apply. But if he collected evidence and then filed a case without leaking the information to the public, I don’t see the issue. While stalking a person with a private investigator is morally wrong in my opinion (they should collect the evidence themselves), it’s common in adultery cases.
Ask him to lawyer up, a proper lawyer will ensure he wont be jailed. However if the private investogator and your friend broke the law by stalking her to the point she feared for her life, then it will be more difficult to save him

PAs far as our practice goes, both the spouses are bringing the evidences of their counter parts cheating and such evidence is considered valid by the courts. While collecting such evidence if anyone breaches the safety of the other or through any illegal means, that may attract criminal or cyber law charges. And to answer your question, yes! It does hold! But ofcourse if you come back to India.. you’re in a law-less land – so nobody will enforce it. Look at the state of soooo many women in Punjab who married to UK citizens on paper. They should legally be there now, but their espouses have abandoned them and the UK government can’t help in anyway.
