No, smooth roads aren’t a fundamental right. You can sue them if you don’t have access to any specific location, but not for the quality of roads.

Road tax is for making roads not high quality smooth roads. Toll is for maintenance of roads.

Judges won’t care about them until one of them buys a super car. Which may not happen in the immediate future.
All they can do is issue a notice to the government if you persist.
