        Hello everyone ,

        I’m seeking advice regarding an issue my wife is facing. She had enrolled in a bachelor’s program at a college in India but had to drop out in her second year due to personal reasons (her grandmother was very ill). Recently, she went back to the college to retrieve her original high school certificates, but the institution is refusing to return them.

        The college claims that my wife signed a document agreeing that they would only release her certificates if she paid the full fees for the entire course, even though she didn’t complete it. She does not have a copy of this document, and we’re unsure of its legal validity.

        From what I understand, educational institutions are not legally allowed to withhold original certificates, even for unpaid fees. I’ve also read about UGC guidelines and court rulings against such practices, but the college is still adamant.

        Here’s what I’d like to know:
        1. Can the college legally withhold her certificates, even if she signed such a document?
        2. What steps can we take to get her certificates back without paying the full course fees?
        3. Are there specific laws, precedents, or UGC guidelines we can cite when approaching the college?

        We’re planning to write a formal request to the college, but if that doesn’t work, we’re unsure about the next steps (e.g., police complaint, approaching UGC, or filing a case in court).

        Any guidance or advice on how to handle this situation would be greatly appreciated!

          just apply for duplicate documents which she has submitted

          It’s illegal for college to withhold documents but unfortunately it’s widely practiced all over India. If you drop out, college force you to pay full course fees.

          Other option is to get court order from SC

            Withholding documents is illegal.

            File a complain to ugc and send a legal notice to college.

              Same situation, file a fir for dupes or you’ll lose a lotta money. Or better yet send them a legal notice.
