February 22, 2025 at 3:36 amI work in a very small startup. I told them about my resignation on February 1, but not in any written form. However, they accepted it. My salary for the month of January was not credited (usually it will be credited on 10th), stating that I was in my notice period. Everything was fine, as I had a 30-day notice period. Then, they started giving me very complex tasks and new projects, and threatened to provide me with only a relieving letter and experience certificate if I finished the work. They also stated that, since I did not resign in writing, I could not be relieved.In the offer letter, there is another clause stating that if an employee wishes to resign and leave immediately, despite the standard 30-day notice period, they must compensate the company with an amount equivalent to one month’s salary. I told them that I plan to leave immediately and that they can have my January month’s salary (also I have still been working – February 20). But they are threatening me with absconding charges and filing a police case. Previously, they also threatened to blacklist my career by informing my new employer. this issue has bothered me for last 1 week. please help me

February 22, 2025 at 3:45 amAll professional communication should happen through the official channel.You should have sent an email from your work/personal email to the HR & your manager.
Write a mail to your manager keeping hr in cc. Mention that you resigned on x date and it was approved by them on y date.
Finish your notice period and move on. If its only 1 month of experience, then its not that useful for you either.
Also they cannot keep / deduct salary for days you have worked. They have to pay out.
Wait for their reply, ask them in writing that they won’t pay your salary. And if they do, tell them that you’ll reach out to the labour department.

February 22, 2025 at 8:51 amNALAlso, when you send a resignation mail from your company provided email address, always CC your personal email, so that you have a copy.
Also, If they go to the police they would have to spend time. They are allergic to spending time. Besides, the police wont go after you. The blacklist thing, and withholding payment and experience certificate, is serious, they have no right to do that. They also have no right to give complex tasks during notice period. But you should consult a real lawyer, at their office. Also go to glassdoor and write a review of what they did to you.

February 22, 2025 at 3:46 amWhy the heck would anyone not write and email and resign?Even now, simply write and email quoting the verbal discussion on Feb 1 with who so ever you had of your intent to quit. Request them to treat that day as your resignation date and relieve you on 2nd March (30 days period).
Put every little detail on record over an email and be polite and accommodating about trying to complete all your tasks by 28th Feb and handing over by 2nd March which would be your last working day.
PUT EVERYTHING ON RECORD.

February 22, 2025 at 3:57 ami trusted them and they had the same trust. it was a small company. it suddenly got escalated when one of the investor threatened me to stay. i have a mail from them that i am currently serving notice and will be relieved on mar 2nd. but they added some catch like only if i complete the task within my notice period.-

February 22, 2025 at 5:39 amI am sorry but this is common sense. Itโs totally idiotic to not send formal email. From hr s perspective may be your manager didnโt inform them. And he wouldnโt tell the truth.Itโs a lesson learned and move on.

As per stated clause, they can keep 30 days salary.
Keep it professional, always keep the paper trail. -

February 22, 2025 at 4:12 amtake this as a learning: when initiating any parting of ways, be it an employer, or if you ever are the employer – ensure that you have a paper trail.If an employee, send the resignation email to your immediate manager, cc their manager AND your personal email address. This last bit is also important: if the company is very machiavellian, they can erase the whole email thread since they control the email server. Thus, having your personal address in cc (and expecting their “reply to all” to include replies to be sent to your personal email) is a standard safety measure that I follow.
Similarly, prior to initiating a resignation, take all relevant paperwork (like your original, offer letter, latest company policy as it might have changed since your employment start date), your leave balances as of that date, your current CTC, etc and email it to your personal address. This will ensure that they don’t suddenly change any policy to entrap you. (Most companies wouldn’t go to this extent, but you never know).

February 22, 2025 at 5:17 amThis whole relieving letter nightmare is so huge in India. I have hired folks who were in a similar situation but their old company withheld their experience letter as if people are their slaves.But i do understand this is not a norm in India. People generally think oh document nahi hai then there must be some problem.
If you already have a job and your new employer doesn’t give a crap about the relieving letter, i say quit and be done with it. Plus report them to whatever labor board is there.

February 22, 2025 at 6:38 amSubmit your resignation by email.. Serve a notice of 30 days. Once you resign, the company will expect you complete your assignments without impact or where they will extend beyond your last working day – you transition it to a new owner. -
