        My cousin (34M) has been facing severe harassment from his wife (33F) and her family for the past several years. They have been separated for 4 years, but the legal battles continue. It was an AM when one of our relatives shared her picture and told us the girl lost her mother at a young age and comes from a small town with good values. My cousin is good looking, good heart and has a great job. They told her they live in a joint family and just bought a house for that. All agreed to the alliance and thought it would be a good match. All went well 1st year of marriage, she got pregnant after 15 months and something flipped in her head. Started pestering him to separate from his parents. He refused and this started daily quarrels, leading her to pack her bags and go to her Dad’s home. She gave birth to a boy and then started threatening him that she will file false cases against him.

        The in-laws have filed multiple cases against my cousin and his parents (my uncle and aunt) in various courts in Maharashtra. These include dowry harassment, abuse, mental harassment, and infidelity.

        My cousin has experienced significant distress, including a 20 kg weight loss and severe sleep disturbances. My 70-year-old uncle is forced to travel long distances (6-8 hours) for court appearances, causing immense physical and emotional strain.

        There are concerns about bias in the court proceedings. It appears that the judge often places the burden of proof on my uncle to disprove the wife’s allegations, instead of requiring her to present evidence.

        * We are seeking advice on the best legal strategies to defend my cousin and his parents from these baseless accusations.
        * What steps can be taken to prevent further harassment and ensure the safety and well-being of my cousin and his family?
        * How can we address the perceived bias in the court proceedings?

        We do not want another Atul Subhash and make sure someone is always with him. Someone suggested that converting to a different religion Islam might offer some protection under personal law. However, we are unsure about the validity and implications of this approach. We would appreciate insights from legal professionals on this matter.

            Sorry to hear that OP. It is pathetic it has come down to this. If he has any FD’s etc maybe try converting in Gold and hide those. Try and hide every bit of wealth this person hold. I hope he gets out of this horrible situation. Changing religion now might not help as marriage was done under different act. Check with the lawyers. Can he move overseas?

                I have seen so many of my friends go through this. They are so damaged fighting all fake cases . All life has been sucked out of them. Under current laws, there is no solution to get out of this.
                BTW, judge won’t give her 1 cr. I feel women kind of enjoy having leverage and exploit it to the max.

                In other countries filing false police report is a crime but not here.

                  If your cousin has no income of that sort, court will not order to pay that amount. Demanding & granting are two different things. Your cousin has to show his income details as well as his liabilities.

                  You need a capable advocate who can put all these questions before the court. When there is separation of 4 years, where is the Domestic Relationship? How could in laws be part of Domestic Violence or Dowry Harassment?

                  Your cousin can ask for transfer of case if aged parents have to travel. Wife seems to be capable of travelling, if she can file cases only to frustrate.

                    If multiple cases are filed in different cities on the same issue, your cousin can approach the High Court or Supreme Court to transfer them to one location. Courts allow this to prevent harassment. He can also request the High Court to quash false or repetitive complaints if they are clearly baseless.

                    Your uncle can ask the court to excuse him from personal appearances, especially due to age. As for the Rs. 1 crore alimony, the court will decide based on real income and assets, not just her demand. If your cousin earns modestly and has loans, that should be shown clearly.

                    Changing religion will not help. Courts do not accept conversion to avoid personal law duties. Let me know if you need help preparing a transfer or defence strategy.

                        In case of any robbery or incident, when we go to Police station to lodge a complain, they sometimes deny taking complaint saying *”It doesn’t fall under our jurisdiction”*

                        Similarly, aren’t there any jurisdiction for courts?
