Hi am a Muslim female working in delhi..
I separated with my husband..just left with the child(he has history of violence but I don’t have any proof for that matter)and we didn’t contact each other further..now he calls randomly to ask me to let him meet my boy of 4years or else he will file for custody and snatch him from me..his words!! So I talked to a lawyer and he scared the hell out of me by saying I can keep child for 2 more years than at 7 years court will grant his dad custody as per muslim law!! I mean is law hindering child above 7 yr to live with mom? Or my child be asked whom he wants to stay with..or should I prepare to leave country before he is 7 year old..am so tensed and can’t even sleep..pls advise people where do I stand? I don’t intend to file any cases of DV or Dowry..as his history.
Genuine response only.i want to calmly ..handle things not to affect my child…

Muslim law does state that mothers only have custody until the child reaches 7 years of age. No need to move out of the country tho, you can move to Uttarakhand

Yes as per muslim law father can take custody at 7 year aged child but at the same time it’s not so easy. Because paramount consideration of court in custody matter is WELFARE AND COMFORT OF CHILD. If men can change religion to marry 4 women, can’t women convert to keep custody of their child? Just asking.
