UMy dad runs a small online business based in Bangalore and delivers all across India. We deal in IND number plates and HSRP number plates.
I found out now that he was summoned with a notice to Mumbai and he was going to go but apparently he missed the deadline. They showed up at our home.
On 15th night, a few people from Cyber Police showed up to our house in Bangalore and arrested my father, late at night. They took him to the nearby police station first and then hour later came back home with my father and handed me a Arrest Information to sign [as per section 48 of B.N.S.S.]. They asked me pack a two – three days bag for my dad and left immediately with him.
All of it happened very quickly. Before we could ask any questions.
They took him to Mumbai, I have spoken to him twice on very short calls. He says he is in Byculla Cyber Cell. I have very little information of what’s going on. All he said was somebody filed a case saying we run a fake business.
He’s been charged with –
Sub-section (3) of section 35 of Bhartiya Nagarik Suraksha Sanhita 2023.
318 (3) BNS R/w Sec – 66 (c), 66 (d) IT Actdated.
I’m very overwhelmed right now. I don’t understand these charges and how to proceed either. If there’s someone out here that can provide insight or help it would be really really helpful. I will be very grateful. 🙏🏻

DYou need to go to Mumbai immediately and engage a lawyer. With the help of the lawyer approach the jurisdictional court to obtain certified copies of the FIR.
The procedure for the Mumbai Police to follow is after arresting him in Bangalore they should have produced him within 24 hours in a local magistrate court to obtain a transit remand to take him to Mumbai. After bringing him to Mumbai they had to produce him in front of a local court in Mumbai and obtain police remand for the purpose of interrogation and investigation. Your lawyer will ensure all procedures are followed and will apply for bail for him.
Be prepared for not getting bail for a few weeks stretching into a few months.

DAlso I would like to add that to the best of my knowledge HSRP number plates can be produced only by government approved contractors and such approvals are specifically for each car. Hopefully your father’s business was following the legal provisions.
