March 31, 2025 at 6:36 pmDad disinherited me and gave everything to my brother in the USEver since my parents got to know that my ex-wife has filed for divorce because of my affair ,my parents are very angry and from past 2 years my dad has been threatening to disinherit me and give everything to my brother, who lives in the US. Recently, I found out that he has already made a will explicitly stating that I will get nothing, and everything will go to my brother.
I donโt know the exact details of the will yet, but I assume it includes both self-acquired and ancestral property. Iโm in banglore , all I know that ancestral property canโt be willed away but he has given all his self acquired property to my brother. Can I challenge this later? Also, what happens if the witnesses of the will are no longer alive? Can I challenge stating that he made this will because of sheer aggression?

March 31, 2025 at 6:53 pmNAL.From what Iโve read and have seen- ancestral property that has been partitioned and registered in your fatherโs name is his self acquired property. Itโs his choice on what to do with it. You can challenge this in court, but you will waste money and your parentโs money.
As for his own acquired property, you have no rights either. Itโs his choice here too.
You should consult an attorney to verify this.

No , I canโt use that tactic for very obvious reasons.
So unless my dad voluntarily adds me again , there is no chance of me getting any part of it in the future? What if me and my parents reconcile then?
I got ripped off completely in my divorce and now my parents have disinherited me ,I am left with nothing much now.

March 31, 2025 at 7:09 pmThe land has to be non-partitioned for 4 generations and passed on as inheritance after death to be considered ancestral property. At any point, if the land was partitioned or willed, it becomes self acquired property of the person. Check how the land was inherited. If it was inherited after the death, then you have to check the other generations. Consult a lawyer. In India, law is what you argue and how much you pay the judge anyways unlike western countries. Itโs not absolute.-

As for properties and stuff- Yes itโs nice to cry in a Mercedes than on a street, but end of the day itโs still crying. Your most important assets is your family. Money comes and goes. Be thankful and apologize to the fam. And move on.-

I am giving alimony and child support separately and it was not concluded by considering my parents property.

The child support you have to give till heโs 18 or the girl gets married or she finds a job. I hate that about Indian laws that itโs fatherโs responsibility till the girl gets married.-

Also your father can’t will away the ancestral property so you can still challenge it in court. Get a lawyer asap.Also you are a bitch for cheating on your wife. But whatever some people will never learn. Maybe next time don’t think with your third leg and use some of that brain that you have in your head.

Consult a lawyer, but if substantively what your father did was legal, I would leave it and avoid going after the will based on these technicalities. And overall, I would not do this – you say that you cannot hurt your parents more but dragging them to court, especially when your challenge is tentative, will only add more fuel to the fire. Also, it will likely eliminate any chance of reconciliation.I know that between this and your divorce case, your wealth has been zeroed out. I would not look back but forward at this point. Get a therapist, put your head down, and just focus on work and rebuilding yourself. You are young, both from a perspective of building your wealth again and a personal life. Look back only to learn from your mistakes (because it honestly doesnโt seem that you have accepted fully that these are consequences of what you did). Otherwise, your best option is forward.
