March 4, 2025 at 4:28 pmI need serious legal advice. My husband and I have always been responsible when it comes to family planning. We used protection every time, followed all the instructions carefully, and never took any risks. But last month, the condom broke during intercourse, and now I’ve just found out that I’m pregnant despite doing everything right.
This was not a mistake on our part. It was a product failure. If any other defective product causes harm, the manufacturer can be sued so why should condom companies be any different? If a faulty medicine causes illness or a defective airbag fails in an accident, the company is liable. But when a condom fails and leads to a life-changing, permanent responsibility, the company just walks away while we are left to deal with everything?Raising a child is an 18+ year financial commitment, and I was not prepared for this. Shouldn’t the company bear some responsibility for their product’s failure? Can I take them to consumer court under the Consumer Protection Act and demand compensation for the expenses of this unplanned pregnancy?
Has anyone in India ever tried suing a condom company for a defective product resulting in pregnancy, and was there any legal success?

March 4, 2025 at 4:33 pmI don’t think so because under the fine print all the comdom companies say that they are not 100 percent safe and under the ambiguity they are on the advantage side and how will you prove that the condom was defective and you used it properly.. Do you have any proof that you used that particular piece. -

March 4, 2025 at 4:35 pmHow will you prove that this pregnancy happened due to the sex with the condom?
Frankly, anyone can get pregnant and then claim they use a condom. -
