        I had given a security check to a builder for completion of a specific work. He fled the scene and did not complete the work after which I put a check stop from my bank. Now he has filed 138 against me. There are no agreements in place but everything is on chats. What grounds do I have to defend my case and what are the chances of winning anything?

          You can, say your point. If he argues that a check with a agreement is a loan repayment ask him for proofs that he paid you anything. He did not complete the work, that’s not your fault. Hire a good lawyer

            He has to prove “**cheque was issued to discharge a legally enforceable liability or debt**”

              If he had already filed a case against you. To have appear before the court either in person or through your lawyer. He must prove that he has completed the work and more over did you get any legal notice and what are specific allegations that are against you. And DO you have the documents of case and so that we can have perfect defense depends on the allegation against you.
